There is no federal sexual violence law. This is why all states took so long to legalize marital rape in 1993. Rape- sexual intercourse or unnatural intercourse with a person by force and against his will or by threat of bodily injury. Unnatural sexual intercurse is not defined in the statute. Sexual assault other then rape there is no crime called sexual assault in ma prosecuted as related crimes of indecent assault and battery . Indecent assault and battery is not defined by the statute. There are separate laws involving children under age 16 elderly people and people with disabilities. Intercourse where consent is achieved by fraud does not constitute rape. Women had sex with man while intoxicated she thought man was her bf but it was her bf brother claims she was raped because she thought he was someone else mass says this isn"t rape.
