It is a social construction of the war. The south fought for states rights, not slavery. Slaves were content, safe, in good conditions, etc. The soldiers on both sides all fought the good fight". The south was beaten not because they had a bad idea/moral system, but because they were overpowered. The consensus is the idea that slavery is against natural law . Natural law was believed even by slavers. The right to contract, self ownership, the right to property are all natural laws. Slavery only has a right to exist because of positive law, not natural law. No one was arguing otherwise until the 1830"s. The fight over slavery is over the extension of slavery into the territories. Parts of the constitution protected slavery and parts protected liberty (overtly)
