Document Summary
National government is a blend of popular and state representation (madison"s. Train tracks across the country should match up. The poor are lift in those areas the rich left, with less money for services. Gibbons v. ogden national power over interstate commerce. Court decisions restricted federal power to regulate commerce within states. Prevented federal legislation on minimum wage, worker protections (temporarily) killed some new deal programs. Majority began to allow federal regulation of commerce, interpreted broadly. Burden is on national government to show usefulness of nationalizing policy. Arizona case: arizona was going too far on rules regarding immigration and border control. Didn"t want to have 50 different immigration policies (coordination issue) House: national elected by the people (nationalizing force) Tyranny can happen at any level of government, contrary to madison. One lesson: difficult to be principled about whether policies should be decided at the local (state) or national level.
