Document Summary

Average patent case is 3 to 5 million dollars per side, 5-8 years to go to trial: parties, plaintiff v. defendant. Plaintiff is the sue-er, defendant is the sue-ee: counterclaims. When the defendant sues the plaintiff, all of the claims have to be settled in the case. Any claim, doesn"t have to be related to case: third-party defendant. When defendant blames someone else and brings them in. Ex: go to get brakes, come out and brakes fail. They have an army of lawyers and rather get to the case earlier: class actions. When a bunch of people sue a company for the same reason, all parties like it because it"s easier and allows the defendant to be held accountable. Most people wouldn"t sue a company for 10 dollars of damage. Pros: attorneys paid based on % of settlement. Cons: attorneys file a lot of class action cases because they can earn a lot of money: requirements for bringing suit.
