- The more fundamentally important a liberty is, the more it is protected under
means end
- Strict Scrutiny
- Compelling interest and is necessary for the government to
infringe
- Compelling Ends
- Almost nothing that the government does passes Strict
Scrutiny
- Intermediate Scrutiny
- Must directly advance a substantial Government interest
- Be no more extensive than necessary to do so
- Substantial Ends
- Rational Basis
- Government needs a reasonable relation to achievement of a
legitimate governmental purpose
- Example: Business activity, commercial
- Legitimate Ends
