Once they pass this number it is necessary for the employers to provide workers comp. Some of these states lower the threshold if the employer falls within a contractor classification or involve contact with ionizing radiation. Each state has own laws to define the employee-employer relationship. Each has own definition or applies a different test to define employee . Each state has different rules on exempt workers. Only recourse available to cover medical costs or lost wages is the legal system.
