Goals: crime control- repression of crime, threat to liberty=crime, due process- fairness in law, threat to liberty=incarceration and stigma, legitimacy of system, crime control- relies upon enforcement of laws. If not enforcing, then it will reduce deterrence effect: due process- relies upon fairness of system. People won"t follow laws if they are unfair. Starts with realization that criminal justice system handles many cases with only few resources/time. Not enough people in resource to process them (cases) Investigation (valuable info is available/ most important part: process a lot of cases without a lot of energy and time since there are so many to go thru. Informality (trials or pleas: pleas are more efficient. Uniformity: treat everyone the same in order to be efficient. Finality: people can appeal to a higher court, they don"t want people to appeal (cid:271)e(cid:272)ause 1) reduce deterrence effect 2) slows down efficiency. Reduces mistakes and that the state should be working slow and hard on these cases.
