Against a person"s will by any means of force, violence, menace, or fear of immediate & unlawful bodily injury. A person is prevented from resisting by any intoxicating or anesthetic substance. Incapable of giving legal consent (age, mental disorder, developmental or physical disability, intoxication) A person is at the time unconscious of the nature of the act & this is reasonably known to the assailant (including asleep)
