Should have the right to dismiss someone. Tenure of office act 1867: restrict the power of the president to remove certain office- holders without the approval of the senate. Elected in 1885 and served 4 years, lost presidency and then won again in 1893. Wrote a letter to congress about how he took an oath to support constitution and does not believe it complies with constitution. Myers v. u. s. 1926: supreme court said the law was unconstitutional. Dicta: have no bearing or precedent on anything because its gone. Recess appointments: assumed us senate would hardly be at capitol when president was there. President might need to fill a position without their approval, but temporary until after next session of congress ends. Modern times not essential, senate stay all the time and rarely leave. People on commission are appointed with approval of senate. Several openings, obama appointed 4 people while senate was on recess.
