If candidates fail to receive majority (270 of 538) votes the election is thrown into the house of reps. 12th amendment: distinction between voting between president and vice presidents. Judicial review: not planned by constitutional framers, madison did not believe an unelected branch should have this type of power. 3/5 compromise: slaves counted as 3/5ths of a person when considering population for house of reps numbers. What agree to it: north needed constitutional rati cation, logrolling: South: unrestricted import of slaves until 1808 and returning go runaway slaves. Enactment occurs when 3/4 of the states pass it. Constitution was amended 27 times: congress had initiated the process every time, state legislatures did the ratifying.
