A peace officer may arrest without warrant. (a) a person who has committed an indictable offence or who, on reasonable grounds, he believes has committed or is about to commit an indictable offence; (b) a person whom he finds committing a criminal offence; or. Police have the common law power to briefly detain suspects for investigative purposes on standard of reasonable suspicion: r. v. mann. Police may carry out a limited search incident to investigative detention if the have reasonable grounds. This could include a search of a car: 9 and 10 of the charter refers to a suspension of the individual"s liberty interest by a significant physical or psychological restraint. In cases where there is no physical restraint or legal obligation, it may not be clear whether a person has been detained.
