Civil liberties are limitations on government power intended to protect freedoms. Civil rights are guarantees that government will treat people will be treated equally regardless of race, gender, ethnicity etc. There are a number of different protected classes in the us: the native americans, the disabled, americans with disabilities act, chinese immigrants. Institutions and government need to discriminate in the course of business: ex. Tcnj discriminates against some students based on certain metrics such as. Gpa, grades, extracurriculars, sat scores: rational basis test, there must be a good reason for a discriminatory practice. In courts, the burden of proof is on the individual or group challenging a practice or law as unacceptable. Civil liberties are not enough to protect civil rights. How do we solve problems with education and civil liberties: busing, lotteries, school choice, we have not reached a point where there is equal access to education across racial divisions.
