Civil rights are guarantees that government will treat people will be treated equally regardless of race, gender, ethnicity etc. There are a number of different protected classes in the us: the native americans, the disabled, americans with disabilities act, chinese immigrants. Institutions and government need to discriminate in the course of business: ex. Tcnj discriminates against some students based on certain metrics such as. Gpa, grades, extracurriculars, sat scores: rational basis test, there must be a good reason for a discriminatory practice. In courts, the burden of proof is on the individual or group challenging a practice or law as unacceptable. Civil liberties are not enough to protect civil rights. How do we solve problems with education and civil liberties: busing, lotteries, school choice, we have not reached a point where there is equal access to education across racial divisions.
