Criminal process typically begins with an arrest: an arrest is the deprivation of liberty o an individual by a legal authority. A complaint may be filled out by a police officer, prosecutor, or a private citizen and serves as the initial charging document. Consists of filling out paperwork that records the arrest and the criminal violation that one is arrested for: fingerprints and photograph will be taken, many arrestees especially for minor offenses are then released without any bail being set. If a suspect is arrested, booked, and confined, he/she will be brought before a lower court judge (municipal court in nj) for his/her initial appearance. One must be brought before the judge without unnecessary delay. The judge advises the accused of why they are being detained, to the right to a trial by jury, and to the right to have an attorney appointed if he/she cannot afford one.
