B. The Abortion Issue (termination of pregnancy)
● Legalized abortion.
●Roe v. Wade
, 1973 U.S. Supreme Court decision; ruling was based on a woman’s right
to privacy.
Roe vs. Wade (1973) Seven to two vote.
Women have a constitutionally protected right to choose abortion; state cannot interfere with
that right.
Pregnancy - trimester. Every 3 months are a semester.
3 rulings:
1st: trimester: the decision to abort is purely private made by a woman in consultation with a
physician.
2nd trimester: more restriction only to protect a woman’s health
3rd trimester: state can prohibit abortions unless to preserve a woman’s health or life, because
of the viability of the fetus.

International (1977) MInors are protected by the same privacy clause in the constitution.
