Why do you think there are increased dealings with police and mentally ill: defunding, reclassification. Three different types of law: criminal, civil, administrative. Different sources of law: local laws and ordinances, state laws, bill of rights governs abuse of power. 4th: unreasonable search and seizure w/o warrant or probable cause. Arrest, search and seizure: reasonable suspicion: must have several levels of proof to act. Cannot act based on a feeling: probable cause: standard of suspicion. Occurs when evidence leads reasonable person to believe a suspect has committed a crime or can possibly coming a crime. Probable cause: observations: using the senses, expertise and circumstantial factors, eyewitness accounts or other officers account. Exclusionary rule: evidence seized illegally cannot be used in court. Violates 4th amendment: exceptions to this rule. Good faith exception officer thought info was lawful. Inevitability of discovery someone was bound to find it. Public safety danger to public so action was taken.
