Grand jury: main function? inditement; meet in secret. Secondhand evidence (circumstantial): can still use (ex: b is murdered, a is a suspect, didn"t see a murder b but earlier in the evening i saw a & b arguing and threaten to kill b) Prison overcrowding because of tougher sentencing, mandatory sentencing. Hear-say: out of court statement where declarant is unavailable (generally not allowed) but not automatically excluded; there are times when you"re allowed hear-say evidence. Deterrence: deter future crime (not an eye for an eye ) Retribution: eye for an eye done for vengeance. More people serving drug ofenses than anything else in prison (federal only) Community based corrections: probation (#1), parole, home coninement. > more people serving community based sentencing than in prison. Pre-sentence investigation: why judge uses it and what it is. Guilty pleas: can plead guilty at any time but judge doesn"t necessarily have to accept plea. Discovery: have to turn over any reports.
