Document Summary

Laws: rules of conduct that proscribe or mandate certain forms of behavior (tell us what we cannot or must do) Statutory law: written or codified law as enacted by a government body or agency having the power to make laws. Creation of law is the result of powerful interest groups that have succeeded in having their values formally endorsed. English common law: usage and custom rather than from written statutes. Stare decisis: legal principle requiring that, in subsequent cases on similar issues of fact or law, courts should be bound by their earlier decisions and by those of higher courts having jurisdiction over them. Prior decisions can be overruled or modified by higher courts. Rule of law: the belief that an orderly society must be governed by established principles and codes that are applied uniformly and fairly to all of its members. Establishes limits to all types of behavior and communicates expectations on how one should behave in a democracy.
