Warrantless: times when you don"t need a warrant, special needs for the greater good of others. Going to the bjc, airport: incident to an arrest. Anything on you when you are arrest is fair game: exigent circumstances. Vehicles are mobile and evidence is removable. Arrest of driver, search of passengers: stop and frisk. Illegally obtained evidence may be banned from trail. This includes physical evidence and tesimonial evidence obtained by coerced or non-voluntary statements. Know the raionale for the exclusionary rule. Per the us supreme court: protecion of the 4th amendment, consituional rights fall apart if government oicials violate law, no alternaives exist that support otherwise. Good faith excepions: mistake or inaccuracies stated in aidavit lead the judge to issue a warrant when pc does not actually exist.
