Document Summary
Restitutive law aimed at crimes against individuals or small segments of society (violation of a legal contract between parties or small group) These crimes tend not to violate the collective consciousness. Restitutive sanction meant to restore relationship between affected parties to pre-violated states. Take-home point: societies with more restitutive law are characterized by social solidarity based on interdependence of members. Consequences of organic solidarity for society: weaker collective consciousness, more individuality and freedom of action, greater differentiation among but also greater interdependence of individual parts, what are the causes of the division of labor: Higher physical and moral density leads to: a greater division of labor, which brings about a: modern social order characterized by organic solidarity. Division of labor is the engine of modern social order: pathological forms of the division of labor: Pathological due to lack of correspondence between tasks and abilities. People are forced to work in jobs that do not correspond to their real talents.
