Parties in lawsuit must comply to procedural rules of court. Rules provide a framework for every dispute and specify what must be done at each stage of the litigation process. Federal rules of civic procedures (frcp): governs civil trials held in federal district courts. Attorney advises what to expect in a lawsuit, probability of success at trial, and procedures involved. Company tries to limit fees through in-house lawyers, negotiation having things on per project basis instead of hourly, be organized. Depends on what the client is up to do- if client is willing to undergo a length trial and appeals, attorney will pursue that route. Other times after learning the costs, the client may decide on a settlement. Must also consider the defendant"s ability to pay damages sought. Includes filing of the pleadings, gathering of evidence (called the discovery), etc. Pleadings: are complaints and answers (and other legal documents discussed)
