The majority design of the judicial branch was left to congress. Where cases begin -- first heard by a judge and maybe a jury. Heard by a magistrate (junior justice) in federal court. After a trial takes place, you can try your case here if you"re unhappy with the result. 13 circuit courts of appeals (12 geographically spread, 1 in washington d. c. ) Two sides face each other and present their evidence. In theory, this is how you get to the truth. Plaintiff - person or group who files a lawsuit against someone else. Defendant - person or group who the lawsuit is against. Non-political system, but sometimes the courts have to make a decision somewhat political. There should be no room for personal preference in decisions, it should be based on law. Asserted by hamilton that they have this power even though it"s not specifically mentioned in the constitution.
