This harm is called, in a legal point of view, damage: both material and immaterial damage exist. = deals with the conditions under which someone has suffered damage can claim compensation for this damage from someone else. 2 types of liability: contractual liability (under contractual setting) and tort liability/tort law. Main rule = damage must be borne by the person who suffered it in the first place. 2 exceptions = fault liability and strict liability. Governed by the demands of 2 kinds of justice: corrective and distributive: corrective. Damage must be remedied, that is, the person who suffered the damage must be brought to the same position he or she was in before the damage occurred.
