Debates about federalism center mainly around the question of which government is in charge? of various policy matters federal government or state government. Want to instill a sense of nationalism, but retain strong sense of loyalty to their states. Necessary and proper clause, commerce clause, general. Supremacy clause: the federal government law overrules state government laws if they come into con ict (ex: medical marijuana) Habeas corpus: you are protected from unlawful detainment if you are an american citizen. Ex post facto laws: you can"t be arrested for doing something if it was legal when you did it. States cannot discriminate against citizens of another state. States must respect judicial proceedings of every other state . States and supporters of states rights wanted the right to nullify federal laws they deemed unconstitutional. Constitution doesn"t address this, federalist papers are clear that declaring laws unconstitutional is a job for courts, not states.
