Document Summary

Classical theorist = believe that main instrument of control if fear, if you have a sign in a convenience store that says do not shoplift you are on camera it will prevent people from shoplifting. Classical theories: jeremy bentham (created panopticon) and cesare beccaria are fathers of the classical theory. Utilitarian: greatest good for greatest amount of people, punishing you to prevent you from doing it again. Positivist theorist = argues that humans don"t have free will, their behavior determined by various biological, psychological, and sociological factors. They want judges to determine your fate, they focus on the criminal not the crime, why they would do such a thing, what influences they have had and this influences what kind of punishment the criminal deserves. They kind of think that everything that happened to you, is predetermined, force you to commit the crime, so kind of it not all on you as the criminal.
