Document Summary

Be careful who you waive it for. 5 th amendment (right to life, liberty, and property) Nor shall private property be taken for public use without just compensation. Constitutional rule regarding eminent domain every country has the power to take public private property, but they must be fairly compensated. If you have committed a crime they just take your shit. Do it because they believe that it would be beneficial for society. This is not the purpose of eminent domain. Grand jury: not a trial, secret prosecutorial proceeding (investigation) don"t have to be secret, but they often are, because the person is not yet a defendant. In time of war and public danger and for noncitizens these don"t apply. Double jeopardy if a criminal defendant is prosecuted for a particular crime by a particular jurisdiction (state, federal) and found not guilty for it, he or she cannot be prosecuted for that crime again.
