Criminal law: governs us as society at large (behavior) States objective if found guilty: punishment (fines-paid to state not victim, deprive of. Injuring society at large liberty, lose life)/deterrence/rehabilitation (modify behavior) Civil law: behavior we are supposed to have towards each other on personal level. Meant to compensate (no ability to punish), try to right the wrong against the victim: put victim back in position before incident. Factors going into how much compensation- medical bills/pain and suffering: punitive damages: punish. Civil procedure: law that exists so people don"t take law into own hands . Prove what happened to you, get decision in favor to compensate. No one can be deprived of life, liberty or property without due process of law: due process: (interpreted case by case) Complaint (just have to allege facts, not evidence, petition: allegations, plaintiff (pi): party suing, defendant (delta): party being sued. Don"t have to bring up facts or proof.
