Civil law actions are between a claimant (previously plaintiff) and a defendant. Claimants must prove their case based upon the balance of probability. They must prove that it is more likely than not the defendant is liable. Three elements must be proven for a successful case: a contract between the parties existed (or an event that caused damage, a damage was caused. The contract was breached (or a event occurred that caused damage) If the claimant is successful the defendant will have to pay compensation or they will have to perform the desired action. Criminal law prosecutions are usually brought by the crown against defendants. The prosecution must prove its case beyond a reasonable doubt (< 98%) It is better to have a guilty man on the street than an innocent in jail. If the crown succeeds the defendant is found guilty, then jailed, fined or compelled to perform community service.
