Federal rules and regulations have force of law to make rules. Agencies make three types of rules in three different ways. All three methods start w/ publication of notice of proposed rule. Once rule published all three procedures allow for comment period. Parties affected can contact agency and leave comments. If at end of 30 day period comments deemed insignificant, 30 day rule becomes final rule. Agency required to conduct a legislative type hearing, that permits no cross examination (informal) Congress retains right to budget for that agency. Congress can strike down agency actions if it is outside the authority given by congress in the enabling statute or if its arbitrary and capricious or unconstitutional.
