Trade secret protection is not limited to the expression of an idea though something held as a trade secret may be copyrightable as well. Unlike patents, trade secrets do not require novelty to receive legal protection though otherwise patentable technology may be held as a trade secret. The owner thereof has taken reasonable measures to keep such information secret. The information derives independent economic value, actual or potential, from not being known to, and not being readily ascertainable through proper means by, the public. An overwhelming majority of states have adopted some version of the utsa. Learning curve toys, inc. v. playwood toys, inc. Breakdown: playwood sued learning curve for misappropriation of a trade secret in a realistic looking and sounding toy railroad track.
