Thomas: theories and interpretations of the first amendment. Sc has the final say on what the constitution means. Exceptions: subsequent sc rulings and constitutional amendments. Government can"t regulate your speech but they can regulate the time, place, and manner! Status of visitors or those in country illegally is unclear. Speech doesn"t have to be interpreted literally images. First amendment emerges out of enlightenment philosophy and fear of censorship irony: undermined by alien & sedition acts long period of silence of first amendment throughout 19th century. First amendment philosophy stems from 20th and 21st century sc decisions. Provide marketplace of ideas (milton/oliver windell holmes) to find truth. Free speech is how a democracy functions. Goal of 1st amendment is to stimulate political participation. Government is fairer if monitored think of the watchdog symbol. Letting off steam - angry speech is better than angry deeds. First amendment is a teaching tool to help us understand.
