The needs of democracy outweigh the right to privacy. When potential harm outweighs the likely benefit: children, sex crime victims, military secrets. Someone who should reasonably expect media attention or invited it. Someone who had no reason to expect media attention and did not invite it. Does inviting media attention in one part of life open other parts of your life scrutiny. Legitimate media typically respect conduct that would not have been visible or audible to a member of the general public: gray area: what is reasonable". A false statement that is published or broadcasted and is damaging to a person"s reputation. Statement not privileged": privilege: person had legal right to speak, court testimony, government business. Knew or should have known report was false.
