Document Summary

No strict constitutional separation of powers at state level; state constitutions don"t set out the model like the cth constitution. In practice, both executive and legislature share law making duties. Separation of judicial power is very strict at cth level. Source of this is the constitution, even for state judiciaries. At the federal level, no body can exercise both judicial and non- judicial power. Text and structure of chapter 3 of the constitution provides for separation of powers. S. 71 gives high court its power and gives parliament power to create other federal courts or invest other courts with federal jurisdiction. State supreme courts have been given federal jurisdiction in the past. No court other than these can exercise federal jurisdiction. S. 72 sets out how hc and other federal court"s judges will be appointed. Strict procedure for removing judges from federal court and changing pay ensures judges impartiality.
