A desire for predictability created the doctrine of stare decisis. You have no duty to assist someone in peril unless you created the danger. Over time, changes in society"s norms have an effect on long-standing common law. An example of this changing the innocent bystander rule that applies in emergencies. Tarasoff was killed and family sued the therapist (dr. moore) of the man that killed tarasoff--moore knew that the man wanted to kill tarasoff. Court dismissed the case because of bystander oblication and doctor-patient confidentiality. Tarasoff"s family appealed and they eventually accepted a settlement. Court of last resort--hear the case one more time. Statutes affect each of us in our business, professional, and personal lives. A proposed statute, submitted to congress or a state legislature. After it passes committee, the bill goes to the full body of that house for a vote. It is assigned to a committee and the process repeats.
