Tort = a wrongful act or infringement of a right causing injury or damages (a harm) Frivolous lawsuit - a lawsuit based on no real legal standing. Viewed as a frivolous lawsuit by much of the us public. Key pieces of evidence used included many other complaints of the water temp at mcdonald"s, requirement in the employee handbook of how hot water had to be kept. Tort reform: laws that restrict people"s rights to go to court and/or the damages they can get. Caps on damages: a limit on the amount of money you can win. Compensatory damages - putting the plaintiff back in the position they would"ve been in had harm not occurred. Economic: medical bills, lost wages, future (caretaking, med. bills, etc), property damage. Anything you can affix a number to. Non-economic: pain and suffering , quality of life. Punitive damages: getting the company to change their behavior. Tort law is substantive, could be civil or criminal.
