1. Authority of the Commissioner
a. Leagues are private entities that are not subject to the constraints of the US Constitution
i. A league is primarily governed by contracts and association rules
ii. Thus, considerable latitude is given to self-governance
iii. Leagues are required to adhere to their own rules and bylaws
iv. Courts will intervene or review the actions of a professional league where “the
rules, regulations or judgments of the association are in contravention to the laws
of the lands or in disregard of the charter or bylaws of the association and where
the association has failed to follow the basic rudiments of due process of law.”
