A new addition to american constitutionalism as there had not been a previous equal protection clause that became part of the national constitution. When the 14th amendment was ratified, the goal of the equal protection clause was to ensure that african. Americans, that were freed former slaves, received the same protection under the law that every other citizen received. The union army occupied southern states from 1865 (the end of the civil war) to 1877. During this time, the south was under military governments, with the union army being in the south, an occupied and conquered territory. Enforcing the ability of african americans allowed them to be equal participants in american democracy. Once reconstruction ended in 1877, the racists in the south were able to regain control of the state governments, as seen in the situation of jim crow and the creation of jim crow laws (segregation) Civil rights act of 1875 and civil rights cases of 1883.
