Witnesses are a huge and important part of investigations. o. Critiques of witnesses acknowledge they are valuable, but look for area of improvement. Show-ups: one suspect is brought in and the police ask the witness to identify whether or not this is the correct person. If the police arrest a suspect and bring them in for a show-up, the police believe that they are guilty. The courts have historically been okay with show-ups, but they"ve had reservations: photo arrays: involves photos/mugshots. Biggest concern: photo of the suspect standing out. If so, under the totality of the circumstances, did the procedure give rise to a substantial likelihood of misidentification? o. Live lineup: involves live people standing in front of the witness. Fillers and suspect: mix of fillers (non-suspects) and the suspect. **these end up dealing more with 6th amendment right to counsel: united states v. wade (1967) Facts: wade (with tape on his face) and another person committed a robbery.
