James kindler killed a number of people. American people killings happened in the us (crimes were murder); they fled to canada. When they came to canada, they obviously didn"t come in properly they get kicked out. They argued that if they are extradited back to the usa, they would be executed for their crimes. Canada got rid (abolished) of their death sentence in 1976 (officially) Minister of justice we"re going to send you back, they are a democracy, they can decide what they would like and you can make all the arguments. By not extraditing them back to the usa, a precedent would be sent. Argued this issue in court saying that this was a violation of their section 7 rights to life. Canada basically said that we"re not killing you, we"re sending you back to a country where you may or may not be killed for your crimes.
