Public law i class 4 october 4th, 2016. Sec 92(14) of constitution give provinces more power to establish jurisdiction. It gives provinces the autonomy to administer federal laws. This section gives provinces the power over provincial and federal jurisdiction. It cannot however create federal but can administer federal law. When there is an appeal at the level of the provincial supreme court, it goes past the federal all the way to the supreme national court. This is because the judges at the provincial supreme court level are appointed by the federal courts. The reason for judicial independence is that no one is above the law because if the government influences decisions of the court it would be impartial and unfair so it needs to be independent for legitimacy. This is uphold through constitutional guarantees such as one, tenure - they cannot be removed (unless they commit criminal act).
