Factors (race, gender, class) coming into effect to determine who gets death penalty. The goal is to keep the rest of society separate and safe from criminal. Bloody code (250 capital crimes) mostly oriented toward the protection of property; giving the message that those who are caught will be punished so harshly- without police force, the bloody code was used to prevent crime. Lacking a police force, such a harsh code relied on extreme deterrence. If you were a victim of a crime, it was up to you to find the suspect, evidence and have an arrest warrant; judges only took over in court. Majesty (showing that the law was overwhelming and ordained by god; court as a spectacle with judge on pedestal; god"s justice; elevated above ordinary mortals) Equality/justice (the law cannot be arbitrary; prosecution for a specific crime, following a specific procedure, exactly the same as everyone else)
