The contemporary cjs is very much a function of capitalist society. The people who own stuff tell the people who don"t own stuff what to do (ownership is still the key) Adam smith, john locke, karl marx all agreed on this. The system is predicated on ownership, thus the law and order system must protect ownership. The only property owners besides the crown were the aristocracy. No taxation without representation emanates from magna carta. While political powers are expanding into other areas, the criminal law is going to evolve to protect those property owners, and a series of sanctions against property offenses are going to protect those people. ^-what emerges from those revolutions is really a recognition that above all else, property must be protected. Even the rights of the individuals are defined with those property (the person is the property)
