CRIM 2652 Lecture Notes - Lecture 9: Racial Profiling, Crown Attorney, Racialization
Document Summary
Griffiths, considerations in the study of criminal justice [ch. 5] pp. 43-52. Inequality in cjs with their treatment of people: racial profiling definition (45), definition of racialization, racialization notion that certain races engage in crime, criminalize certain acts which are associated with certain groups. Report of the ontario commission on systemic racism in the canadian criminal justice. A major survey conducted in metropolitan toronto found that 58% black residents, 31% chinese residents and 36% white residents believe judges do not treat black people the same as white people: racism has a long history in canada. Racialized assumptions and stereotypes may influence these decisions in various ways, some quite subtle: the dominant issue of systemic racism raised by victims concerned mandatory charging policies in family violence cases. These policies are intended to reduce or eliminate police discretion to handle family violence informally and crown attorney discretion to withdraw charges or otherwise abandon prosecutions: sentencing is highly discretionary, with considerable scope for disparate outcomes.
