Non possessory interests
• Easement gives the holder the right to use but not to possess the real
estate. Easement appurtenant attaches to land and is not personal
right; Easement in gross does not benefit a property, it benefits
owner.
o Express Easement is owner write to tenement
o Dominant Tenement is easement accompanies ownership
o Implied Easement is give easement to part of the land to
benefit other parts
o Easement by Necessity is easement land in middle of other
lands that has no access to outside world
o Easement by Prescription is a stranger uses the land for
prescribed period of time without pretense \
o
• Profits is the right to take a portion of the soil or timber or remove
subsurface minerals owned by someone else
• Licenses is the right to go on land owned by another for a specific
purpose such as movie ticket or sport ticket
• Security Interests Is that bank can take your house if you don’t pay
the mortgage
