If a youth successfully completes an extrajudical measures program his or her involvement with the criminal justice system is over. In this unit we will discuss the structure and process of diversion as well as issues with diversionary practices. A youth"s involvement with the justice system begins with police contact either directly or through a complaint laid against the youth. Police have a considerable amount of discretion in making decisions about how to proceed with the accused youth. Section 6(1) of the ycja requires the police to consider if warning or cautioning a youth is a sufficient response to the behaviour. However, section 6(2) states that it is not a violation of youths" legal rights if the police fail to do so.
