Constitutional arrangement where there is a division of powers between central government and the provinces. Divisions of powers: section 91 and section 92, have a good understanding of them. Section 92: 7 health, 13 property and civil rights, 16 local matters. Between 1849-1949 the highest court of appeal for canada was in britin, jcpc juduical commite of the privy council. Pith and substance: what is the essence of the powers were talking about, what is the core power. Extrinsic evidence: admissible evidence that would come from an outside source. Almost all areas of economic activity are provincially regulated with some exceptions such as banking, interprovincial travel (airlines, train,), telecommunications, shipping, nuclear power. Federalism lecture 2: criminal law, economic law, peace, order, and good government. Criminal law + procedure is federal jurisdictions. However, administrating criminal justice (police forces, court houses, prosecuting, offenses), is provincial.
