Where court reconsidered the implications of parks. Accused was tired when he got to a party, drank, slept on couch, a lady was also sleeping on the couch, woke up and he was sexually assaulting her. He went to the police thinking he might be the assaulter, didn"t remember doing it, but remembered something similar. Trial: crown argued not criminally responsible due to mental disorder, defended himself on non-insane automatism, was acquitted, not product of mental disorder because not voluntary. Appeal: absolute acquittal means no way to control it or monitor it, medical evidence. After this, he saw a psychiatrist, referred to dr. shapiro. Shapiro gave evidence that sexsomnia is a parasomniac event. Some people have a genetic predisposition to it, don"t know what you"re doing, no cure for it, he gave evidence that he was really tired so was exhausted. To avoid it, have to avoid being tired, avoid alcohol, take medication.
