What is the test for causation in this particular situation. Can plaintiff prove defendant"s negligence act caused injury. Must only prove negligent act was a cause, not the most important cause, or a direct cause, or immediate cause. But for the defendant negligence, would the plaintiff have suffered injury. Plaintiff drank tea, felt sick, went to hospital. No doctor - called doctor and doc said send him home. Breach standard of care and duty to serve him. Claimed were not liable they did not cause his death. Would him being admitted to hospital cause him to be alive. Not liable - he would have died anyways. Plaintiff falls asleep on wheel of ferry. Hears kids and drives off the edge of ferry. Sues cnr - no bright yellow rope on edge of ferry. Courts - lol you"re dumb - absence of rope did not cause injury. Park - both ends someone operates carousel.
