Employer must pay when an employee 1. 5 pay when they pay more than 44 hours. But statute says, unless the government tells you otherwise. The government is delegated the power to change this statutory revision. Despite the act, an employee working in a seasonal job(canning vegetables, processing them) they get overtime when working 50+ hours. Act does not apply to firefighters, persons in fishing/hunting, people employed to install/maintain swimming pools. Each decision determines the law as it applies to that dispute and (in theory) helps determines the law applicable to other similar matters.
