Chapter 7: standard of care and its breach. Part 1: the legal meaning of the term negligence. The great majority of claims against health professionals are based on negligence and most of these cases turn on whether the professional breached the standard of care. The court typically undertakes a detailed review of the facts of the case in determining if the standard of care has been breached. (a) assessment and diagnosis. Part 2: standard of care expected of various health professionals (a) general practitioners (gps), and rural and family physicians. These practitioners are expected to know their own limits and when they need to refer patients to those with greater expertise. The locality rule has been greatly narrowed with the advent of modern communications and publishing technology. Professional licensing bodies and the courts have increasingly demanded that all physicians are expected to keep abreast (up-to-date) of developments in their fields of practice through appropriate journals, conferences and continuing education programs.
