Starting point: context: measuring whether or not someone is indigenous is a very complex issue: it"s a self- report. May not be accurate: change in the indian act led to change in statistics of overrepresentation. In 2016: 4. 9% population: ^ more people are newly identifying themselves on the census: people are saying now, Or different than what they say on the census: ^ we"re not challenging over-representation because the sheer numbers show that over- representation is real, no need to quibble. Over-representation problems: flow of people is different, ontario prisoners serving sentences less than 30 days, federal serving at least 2 years. Much slower flow in the federal system: a lot more indigenous over-representation of women. Criminal code: says that gravity of the offense = sentence, all available sanctions other than imprisonment should be considered too. Lets move forward: liberals get in: trudeau receiving truth and reconciliation report: nothing much done in two years.
